US court takes issue with Idaho abortion laws

A U.S. appeals court on Tuesday said an Idaho woman who aborted her pregnancy by taking pills instead of traveling to a clinic or hospital as required by state law should not have been criminally charged.

In the same opinion, the 9th U.S. Circuit Court of Appeals court upheld a U.S District Court decision that ruled the woman could not challenge an Idaho state law that bans most abortions after 19 weeks under the premise that fetuses feel pain at that stage of development.

In 2010, Jennie Linn McCormack, an unmarried mother of three, was pregnant, unemployed and receiving between $200 and $250 a month in child support, according to the court opinion.

McCormack searched for an abortion provider but there were none in Bannock County, where she lived, the court opinion said, adding in a footnote that 87 percent of?counties in the?U.S. do not have abortion providers.??


She knew she could get an abortion in Salt Lake City, Utah, about 138 miles away, but the procedure would cost between $400 and $2,000, the opinion said.

Instead McCormack chose RU-486, a medication that induces an abortion, which she ordered online. The drug is approved for use by the U.S. Food and Drug Administration and can be prescribed over the Internet. The drug is for early pregnancies, however, and McCormack was much farther along.

She confided in a friend, and that friend's sister tipped off police, National Public Radio reported. Police found the fetus wrapped up on her back porch.

McCormack?was charged by Bannock County prosecutors last year under a 1972 Idaho law that requires abortions be performed by a physician at a licensed abortion facility. If convicted, she would have faced up to five years in prison.

?There are many cases where they prosecute or threaten to prosecute a doctor," Richard Hearn, McCormack's attorney, told NPR. "There are not so many where they?ve prosecuted a woman.?

Around the time of her arrest, Idaho passed a statute making it illegal for women to obtain abortions after their 19th week of pregnancy, the AP reported. In the Pain-Capable Unborn Child Protection Act, lawmakers argued that fetuses start feeling pain around 20 weeks.

McCormack was not charged under this statute, although she did challenge it in her lawsuit.

The criminal case against McCormack was dismissed and on Sept. 16, 2011, she filed a broad lawsuit claiming that Idaho's abortion law is unconstitutional because it places an undue burden on women, which flies in the face of the Supreme Court's Roe v. Wade, which legalized abortion in the U.S.

An Idaho federal judge issued an injunction saying the law could not be enforced against McCormack.

In its opinion, the 9th Circuit largely agreed with McCormack and her counsel. Criminal abortion statutes typically apply to doctors, who perform unhealthy abortions that threaten women's safety, the unanimous three-judge panel said.

Further, Idaho's law is at odds with Roe v. Wade, the judges said, because pregnant women should not be criminally charged nor expected to ?explore the intricacies of state abortion statutes."

Under the law, they said, women in McCormack's position have three choices: To carefully read Idaho law, violate the law or not get an abortion.

The opinion also?points to a letter the state's attorney general wrote about the abortion law, in which he says the law "plainly intends to erect a substantial obstacle to the right to choose." ?

At this point in the litigation, only McCormack cannot be prosecuted -- not women generally, the court said. McCormack may ultimately get a judgment that strikes down the law entirely, the 9th Circuit said.

NHL, NHLPA back at negotiating table in New York

NEW YORK (AP) ? The NHL and the players' association have resumed negotiations in an effort to avoid a lockout this weekend.

After not meeting face to face since last Friday, the sides gathered Wednesday at the league office before the NHLPA holds player meetings later Wednesday at a nearby midtown hotel.

The NHL board of governors will convene Thursday with Commissioner Gary Bettman, while the union holds a second day of discussions with as many as 250 players.

The hastily scheduled negotiating session for Wednesday came just hours after NHL Deputy Commissioner Bill Daly said owners and players were both to blame for their failure to reach a new collective bargaining agreement before the current deal expires on Saturday.

This is the first formal session since Aug. 31.

Donald Fehr, the NHLPA's executive director, was generic when meeting the media quickly, on his way into the office Wednesday.

"We have some things to tell them today," he said.

Elsewhere, the union filed an application with Quebec's labor relations board, along with at least 16 players of the Montreal Canadiens, asking it to declare a lockout illegal in the province. A hearing on the application is scheduled for Friday morning in Montreal.

What makes this week unique ? in addition to the deadline looming over all of it, of course ? is the amount of players who will be on hand. It will indeed be the offseason's biggest show of force. Pittsburgh captain Sidney Crosby, one of the league's biggest stars, is one of them. He skated on Tuesday with some of his Penguins teammates in suburban Pittsburgh before traveling to New York.

Industry revenue has grown from $2.1 billion to $3.3 billion annually under the expiring deal. Owners asked players to cut their share of hockey related revenue from 57 to 43 percent, and then modified their offer to 46 percent during a six-year proposal. Players are concerned management hasn't addressed its problems by re-examining the teams' revenue-sharing format.

The sides haven't had a full bargaining session since Aug. 31 and the strife is threatening regular-season openers scheduled to start Oct. 11. The preseason schedule is set to begin on Sept. 19.

An 11-day strike in April 1992 caused 30 games to be postponed, and a 103-day lockout in 1994-95 caused the cancellation of 468 games and delayed the season's start until Jan. 20. The 2004 lockout started Sept. 16 when training camps were to open, as they are this year, and wasn't settled until July 13.

Many of the players who will not attend the meetings will stay back in their respective cities and continue preparations for training camps that may not come. On Monday in Boston, for instance, the Bruins gathered for their annual, pre-camp golf tournament. A similar even occurred in Buffalo on Monday, as well. And in suburban Philadelphia, several Flyers continue to skate on their own at the team's training complex.

Lost in the mix are the coaches. For the most part, they are bystanders in this negotiation. They simply wait to be told who to coach, and more importantly, when.

"You work for the owners and you work with the players," Boston coach Claude Julien said Monday. "It's just a matter of staying out of it and respecting both sides."

Pairing 'Angels' With Cancer Patients - KPLR 11

CHICAGO (CNN) ? Just two weeks after his wedding, Christophe Quancard was diagnosed with glioblastoma, one of the deadliest types of brain tumors.

He was only 35 years old. The news was devastating.

?In our age group, no one is ready for the diagnosis, (or) the possibility,? Quancard said. ?I mean, we know it?s out there, but you didn?t think it would happen when you were still young and had so many other things that you were thinking about.?

Quancard?s team of doctors encouraged him to get in touch with a group called Imerman Angels. The nonprofit matches cancer patients with cancer survivors so they can receive support from someone who has been down a similar path.

Within a few days, Quancard was talking to Greg Cantwell, a 38-year-old survivor of late-stage brain cancer.

Cantwell was diagnosed eight years ago, when his son was 1, and had hoped to live until his son was at least 5.

The boy is now 9. Cantwell is living proof that cancer is not a death sentence. And his experience has given Quancard much-needed help ? and hope ? during a difficult time.

?You don?t know what?s really going to hit you emotionally or what kind of therapies you may not have thought of, how to get help, how to make the best use of the resources you have,? said Quancard, 36. ?You really need someone who?s been through this to help you. ? Somehow it makes it so much easier, even in the very hard parts that are coming.?

Quancard is just one of thousands of cancer patients who?ve found one-on-one support through Imerman Angels.

?We (want) to make sure that people that are diagnosed with cancer are able to reach a survivor who can look them in the eye and say: ?I?ve been there. I beat it. And so will you,? ? said Jonny Imerman, a cancer survivor who started the group in 2002.

Imerman was diagnosed with testicular cancer in 2001, when he was just 26 years old. He went through a rigorous chemotherapy treatment that sometimes would last eight hours a day.

One year later, doctors found more cancer, and Imerman underwent a procedure to remove four tumors from his spine.

Now 37, he says he was fortunate to have the constant support of family and friends as he battled the disease.

?They kept me going,? he said. ?With so much support, I did not have a chance to lose hope.?

But other cancer patients between the ages of 15 and 39 are not always as fortunate. The National Cancer Institute recently reported that progress in treating adolescents and young adults has stagnated. Seven out of 10 patients in the age group go on to live at least five more years, but that statistic hasn?t improved in 30 years.

?Young adults are kind of a lost group of oncology patients,? said Dr. Peter Shaw, director of the Adolescent and Young Adult Oncology Program at Children?s Hospital of Pittsburgh. ?They are in a gray area between pediatric and adult care. Unfortunately, they don?t always find their way to timely, optimal medical care.?

There are several reasons why, Shaw said.

?They historically have been the least-insured age group in the U.S., most physicians are less suspicious of cancer in healthy young adults, and many of these patients ? once diagnosed ? may still feel invincible and be in denial, leading to less compliance with their treatments,? he said.

During Imerman?s five-month treatment in 2001, he would walk the hospital halls in Detroit and see young cancer patients who were alone and struggling.

?Everyone is like a caged animal in these rooms. They were lying in bed, motionless, watching television or staring in space. ? You could see the fear in their faces,? Imerman said. ?And I felt guilty as I walked down the hallways and looked in these rooms. And finally ? I just walked in with my I.V. pole one day. ?

?(I said:) ?What kind of cancer do you have? And what kind of chemo do you have?? ? These people were like open arms. They were so excited to have a visitor to talk to them.?

Imerman began engaging other patients and offering support and camaraderie.

?It was instant friendship,? he said. ?You?re not talking surface level. You?re talking about life and death. My goal was to get in there and motivate patients so that they wanted to jump out of their chemo bed and literally start swinging at this thing.?

When Imerman was deemed cancer-free, his health improved and his spirits soared along with his dreams to offer hope to more cancer patients.

Imerman started reaching out to doctors and hospitals and was referred to other cancer survivors. He collected data, spread the word and became a matchmaker of sorts.

Today, nearly a decade later, Imerman Angels has a database of more than 4,000 survivor mentors. The group carefully pairs a cancer fighter with a mentor who had the same type of cancer. And caregivers, such as a spouse, parent, child or friend, can also be paired with other caregivers and survivors.

The group tries to connect people who live in the same city and can meet in person. But its database also extends overseas, and some pairs communicate via phone and Skype. On average, the group creates five to seven pairs a day.

Imerman Angels has made more than 8,000 matches in more than 65 countries.

?(Our) cancer survivors have amazing stories and volunteer to give their story back, to help somebody else out with the same cancer,? Imerman said. ?We share stories. We listen. We learn. We become close and connected, because we expose probably the most vulnerable time of our lives. ?

?I think the bigger picture ? and what we need to do in a cancer world ? is create more friendships.?

Survivors who have navigated the often-complex cancer system can share what they know with patients who are starting at square one and are often unsure where to turn.

?There?s a great benefit for an individual to be able to contact somebody else who?s struggled with the same problem,? said Dr. Steven T. Rosen, director of the Robert H. Lurie Comprehensive Cancer Center of Northwestern University. ?To be able to get the perspective of another patient who can tell them about what to anticipate and also to see someone who?s been through the process, who?s had a good outcome and that there?s a light at the end of the tunnel. In many instances ? it improves their quality of life dramatically.?

Imerman Angels runs on donations, and the majority of its small staff are cancer survivors. Although the group accepts men and women of any age, more than half of its roster is between 18 and 40.

Kevin Madden Defends Attack on Obama for Medicare Cuts

Romney campaign senior adviser Kevin Madden defended Republican vice presidential candidate Rep. Paul Ryan, R-Wis., over his charge that President Obama has "raided" Medicare to pay for "Obamacare" - despite Ryan including the same cuts in his own budget.

"What President Obama did actually weakens Medicare. It takes $700 billion out of it and uses it to spend on a new entitlement, which is part of Obamacare," Madden told me this morning on "This Week." "What Romney-Ryan does is actually restore those cuts, puts it back into Medicare to make it more solvent."

Mitt Romney and Paul Ryan have made that charge repeatedly on the campaign trail this week, saying Obama cut $716 billion from Medicare to pay for the Affordable Care Act - cuts the Romney-Ryan campaign say they will restore.

"The president raids $716 billion from the Medicare program to pay for the Obamacare program," Ryan said at a campaign stop in Florida yesterday. "Here is what Mitt Romney and I will do: We will end the raid of Medicare."

But Ryan proposed keeping the same cuts to Medicare in his own budget proposal this year. And the Obama administration disputes the criticism of the Medicare cuts, saying they reduce waste, fraud and abuse, and cut payments to hospitals, not Medicare services to seniors.

"They're being dishonest about my plans since they can't sell their plans," Obama said in New Hampshire yesterday in response to the attack. "You think they'd avoid talking about Medicare, given the fact that both of them have proposed to voucherize the Medicare system."

Earlier this week, one of the Romney campaign's most prominent surrogates, former New Hampshire Governor John Sununu, also seemed to contradict the campaign's message that Romney and Ryan do not have major differences over the proposed cuts to Medicare.

"When Obama gutted Medicare by taking $717 billion out of it, the Romney plan does not do that," Sununu said Tuesday. "The Ryan plan mimics part of the Obama package there. The Romney plan does not. That's a big difference."

I asked Madden about the discrepancy, and whether the Romney campaign is unfairly targeting Obama over the Medicare cuts. Here's his full response:

TAPPER: "How can you guys be attacking President Obama for cuts to Medicare that Paul Ryan himself proposed, according to your own surrogate, John Sununu?"

MADDEN: "Well, look, starting on Saturday, what you saw was a Romney-Ryan ticket come together with shared values and shared principles about how we would restore those cuts to Medicare and how we would make it more solvent. What President Obama did actually weakens Medicare. It takes $700 billion out of it and uses it to spend on a new entitlement, which is part of Obamacare. So it actually takes the money away from Medicare and spends it in a new way, and that's - that's the wrong approach. That's actually going to hurt current beneficiaries right now."

MADDEN: "What Romney-Ryan does is actually restore those cuts, puts it back into Medicare to make it more solvent, because that's what we need to do, and then it actually looks at other ways which we can continue to make Medicare solvent for future generations. And it doesn't affect any of the beneficiaries that are currently in Medicare. So those are very big differences."
